PEST CONTROL SERVICE CONTRACT.       

This Pest Control Service Contract (the “Agreement”) is made and entered into by and between Knockdown Pest Solutions, PO Box 25415, Tamarac, FL 33320 (hereinafter referred to as the “Service Provider”), and

1. Scope of Services The Service Provider agrees to provide pest control services to the Client's property located at

4. Compliance with Florida Law The Service Provider agrees to comply with all applicable laws and regulations governing pest control practices as outlined by the Florida Department of Agriculture and Consumer Services (FDACS), including but not limited to:

  • Licensing: The Service Provider holds a valid pest control license issued by the Florida Department of Agriculture and Consumer Services (FDACS License Number: JB352029)

  • Notification: The Service Provider will provide the Client with the appropriate notices regarding the use of pesticides and any required warnings or safety instructions, in compliance with state law.

  • Record Keeping: The Service Provider will maintain records of all services rendered, including the chemicals used, the date of application, and any necessary safety precautions taken. These records will be made available to the Client upon request.

  • Safety Compliance: The Service Provider will take all necessary precautions to ensure the safety of the Client, occupants, pets, and property during and after pest control treatments, in accordance with FDACS and EPA guidelines.

5. Rights of the Client

  • Inspection: The Client may request an inspection of the service records and safety information at any time.

  • Termination: The Client has the right to terminate this Agreement at any time, with or without cause, by providing written notice to the Service Provider [Notice Period, e.g., 30 days] in advance.

  • Right to Refuse Pesticides: The Client has the right to refuse the use of any specific pesticide, although such refusal may affect the effectiveness of the treatment.

6. Limitations of Liability The Service Provider will make reasonable efforts to provide effective pest control services; however, no guarantee of complete eradication can be made. The Service Provider is not liable for any damage caused by pests or the use of pest control materials, except in cases of gross negligence or misconduct.

7. Indemnification The Client agrees to indemnify and hold the Service Provider harmless from any and all claims, damages, liabilities, or expenses arising from the Client's failure to follow the safety instructions or warnings provided by the Service Provider.

8. Termination of Agreement Either party may terminate this Agreement with [Notice Period, e.g., 30 days] written notice to the other party. Upon termination, the Client agrees to pay any outstanding amounts for services rendered through the termination date.

9. Governing Law This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising under this Agreement shall be resolved in the courts of Broward County, Florida.

 

10. Miscellaneous

  • Amendments: This Agreement may be amended only by a written document signed by both parties.

  • Severability: If any part of this Agreement is found to be unenforceable, the remainder of the Agreement shall remain in full force and effect.

  • Entire Agreement: This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements or understandings, whether written or oral.
